These Terms of Service (“Terms”) govern your access to and use of soothe-footwear.com (the “Site”) and your purchase of products from Soothe Footwear (“we”, “us”, “our”).
By accessing the Site or placing an order, you agree to these Terms.


1. Use of the Site

You may use this Site only for lawful purposes and in accordance with these Terms.
You must not interfere with the Site’s security, use it fraudulently, or attempt to access restricted areas of our systems.


2. Products & Availability

Product details — including photos, descriptions, and materials — are displayed on each product page.
We make every effort to ensure accuracy, but colours and details may appear slightly different depending on your device settings.
We reserve the right to update, modify, or discontinue products at any time without prior notice.


3. Pricing & Currency

All prices are displayed in Australian Dollars (AUD) and include GST where applicable.
Shipping fees (if any) are shown at checkout or described on our Shipping Policy page.
Promotional pricing may be limited-time and subject to specific terms.


4. Orders & Payment

Placing an order on our Site constitutes an offer to purchase.
We may accept or decline any order, including if:

  • The product is out of stock

  • There is a pricing or description error

  • Fraudulent or suspicious activity is detected

Payments are processed securely through trusted third-party providers.
By completing checkout, you authorise these providers to charge your selected payment method for the total amount shown.


5. Shipping & Delivery

Processing Time: Orders are processed within 1–2 business days (Monday–Friday).
Delivery Timeframe: Most orders arrive within 5–9 business days, depending on your location and Australia Post delivery schedules.

Once your order has been dispatched, you’ll receive an email with your tracking number so you can follow it every step of the way.

Title and risk in the goods pass to you upon delivery to the address you provided.

6. Returns, Exchanges & Refunds

We want you to love your Soothe sandals.
Our full policy is available on the Returns & Exchanges page, but here are the key points:

  • You may request a return within 90 days of delivery, as long as the item is unused and in its original packaging.

  • To start a return, email support@soothe-footwear.com with your order number and reason for return.

  • Return shipping costs are covered by the customer unless the item is faulty or incorrect.

  • If your item arrives damaged or defective, contact us within 7 days with photos. We’ll arrange a replacement or refund as soon as possible.

All returns are processed through our dedicated returns warehouse in China, and the exact address will be provided in your confirmation email.
Please wait for this email before sending your return to avoid delays.

Refunds are issued to your original payment method once the return has been received and inspected.
Nothing in these Terms limits your rights under the Australian Consumer Law (ACL).


7. Cancellations

Orders can be cancelled within 12 hours of purchase if your order has not yet been processed.
Please contact support@soothe-footwear.com promptly with your order number.


8. Prohibited Conduct

You must not use the Site to:

  • Engage in illegal or fraudulent activity

  • Infringe upon intellectual property or privacy rights

  • Harass, defame, or harm others

  • Spread malware, spam, or unauthorised promotional material

  • Attempt to interfere with our website security or operations


9. Intellectual Property

All content on this Site — including text, images, graphics, logos, and code — is owned by or licensed to Soothe Footwear and protected under Australian intellectual property laws.

We are not responsible for their content, privacy practices, or terms.

12. Warranties & Disclaimers

To the fullest extent permitted by law, Soothe Footwear provides the Site and products “as is” and “as available”.
We make no warranties, express or implied, regarding the Site’s operation, accuracy, or availability.

However, nothing in this clause limits your rights under the Australian Consumer Law, including your entitlement to remedies for faulty goods.


13. Limitation of Liability

To the maximum extent permitted by law, Soothe Footwear is not liable for indirect, incidental, or consequential losses — including loss of profits, revenue, or data — arising from your use of the Site or products.
Our total liability for any claim is limited to the purchase price of the product in question.

This limitation does not affect your statutory rights under Australian law.


14. Indemnity

You agree to indemnify and hold Soothe Footwear harmless from any claims, losses, damages, or expenses (including legal fees) resulting from your breach of these Terms or misuse of the Site.


15. Governing Law & Jurisdiction

These Terms are governed by the laws of New South Wales, Australia.
Any disputes will be handled by the courts of New South Wales, without affecting any rights you may have under the Australian Consumer Law.


16. Changes to the Terms

We may update these Terms from time to time.
Changes take effect once published on our Site.
By continuing to use the Site after an update, you agree to the revised Terms.
